Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the BuildLane Dev website (buildlanedev.com) and any web development services provided by BuildLane Dev (ABN 39 658 142 873), located at Level 4, 110 Eagle Street, Brisbane, QLD 4000, Australia. By using our website or engaging our services, you agree to be bound by these Terms.

2. Services

BuildLane Dev provides web development, design, and related digital services as described on our website and in individual project proposals. The specific scope, deliverables, timeline, and pricing for each project are outlined in a separate project proposal or agreement provided before work commences.

3. Quotes and Proposals

All quotes and proposals are valid for 30 days from the date of issue unless otherwise stated. Prices are quoted in Australian Dollars (AUD) and are exclusive of GST unless specified. A project begins only after a signed agreement and receipt of any required deposit payment.

4. Payment Terms

  • A 50% deposit is required before work commences on any project.
  • The remaining balance is due upon project completion, prior to final handover and deployment.
  • For projects exceeding $10,000, milestone-based payments may be arranged as agreed in the project proposal.
  • Invoices are payable within 14 days of issue. Late payments may incur interest at a rate of 2% per month on the outstanding amount.

5. Client Responsibilities

To enable us to deliver your project on time, you agree to:

  • Provide all required content (text, images, branding materials) within agreed timelines
  • Provide timely feedback on designs and development milestones
  • Designate a single point of contact for project communications
  • Ensure any content provided does not infringe on third-party intellectual property rights

6. Intellectual Property

Upon full payment, all custom code, designs, and assets created specifically for your project are transferred to you. BuildLane Dev retains the right to use project screenshots and descriptions in our portfolio and marketing materials unless you request otherwise in writing.

Third-party software, plugins, themes, or libraries used in your project remain subject to their own licences and terms.

7. Revisions and Scope Changes

Each project proposal includes a defined number of revision rounds. Additional revisions or changes to the agreed scope may incur additional charges, which will be communicated and agreed upon before work proceeds.

8. Timeline and Delays

We provide estimated timelines in good faith based on project scope. Delays caused by late content delivery, delayed feedback, or scope changes from the client side may extend the project timeline. We will communicate any timeline changes promptly.

9. Hosting and Maintenance

BuildLane Dev does not provide web hosting as a standard service. We can recommend hosting providers and assist with setup and deployment. Ongoing maintenance and support packages are available separately and detailed in their own agreements.

10. Warranty

We provide a 30-day warranty period after project launch during which we will fix any bugs or issues related to our development work at no additional cost. This warranty does not cover issues caused by third-party software updates, client modifications, or hosting environment changes.

11. Limitation of Liability

To the maximum extent permitted by Australian law, BuildLane Dev's total liability for any claims arising from our services is limited to the total fees paid by the client for the specific project in question. We are not liable for indirect, incidental, or consequential damages including lost revenue, data loss, or business interruption.

12. Termination

Either party may terminate a project agreement with 14 days' written notice. In the event of termination:

  • The client is responsible for payment of all work completed up to the termination date.
  • Any deposit paid is non-refundable unless otherwise agreed in writing.
  • BuildLane Dev will provide all completed work and assets to the client upon final payment.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Queensland.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes constitutes acceptance of the updated Terms.
